Deferred Disposition

Under CCP Article 45.051, For Traffic Violations 

Restrictions:

You cannot request deferred if charged with the following:

  • A violation that occurred in a Construction Zone with Workers Present 
  • If you are a Commercial Driver's License Holder 

Note: If a defendant is under 25 years of age at the time of the traffic offense, they will be REQUIRED to complete a driver's safety course as a condition of deferred.

Requirements

  • A copy of your driver's license
  • A copy of your personal insurance card
  • A defendant must enter a plea of no contest or guilty to request Deferred Disposition
  • A Drivers Safety Course will be ordered if under the age of 25 at the time of the offense
  • A Driver's Safety Course will be required if speed is greater than 24 mph over the speed limit.
  • A Drivers Safety Course will be ordered when there has been an accident
  • A Driving Test with the Department of Public Safety will be ordered if you have a provisional drivers license
  • Return a completed Deferred Application either in person or by mail. If you choose to mail, please send a self addressed stamped envelope (call Court for amount owed)
